Case Win: New Member of the Nurse Union Gets $15,000 WIN

NPAA is here for Nurses in distress

We're thrilled to share a success story from a new nurse member, Chelsea. Chelsea is a member of the NSW branch (NPAN) recently faced significant hurdles in her career but emerged with a successful result thanks to support from the NPAA. Chelsea's resilience and the efforts of our Senior Case Manager Isaac led to some intense negotiations, amicable separation from the organisation and ultimately a pay out. 

The Background:
Chelsea's ordeal began when disciplinary action was initiated against her following a visit from a Health Industry Commission. Allegations related to her role included ‘failure to meet Quality Standards’, ‘treating patients without dignity and respect’, among other issues. The situation escalated quickly, leading to a show cause notice that put Chelsea's employment on the line.

NPAA's Intervention:
Chelsea reached out to the Nurses’ Professionals Association of NSW (NPAN) for assistance, and that's where our involvement began. After a thorough review of the materials, it became clear that Chelsea's case was marred by inconsistencies and unfair practices. We immediately took action, disputing the investigation and highlighting the employer's failure to provide adequate support and training.

Our Response:
In a strategic move, we addressed the discrepancies in the allegations, pointing out that the employer had introduced new information not initially part of the accusations. We also challenged the employer's framing of the issue as a performance concern when the real grounds were related to conduct. Chelsea's multiple years of service with a clean disciplinary record prior to the Commission's visit further supported our argument.

Negotiating a Resolution:
After a meticulous exchange, the employer, acknowledging the NPAA’s advice, offered a compromise. They expressed a willingness to retain Chelsea but asserted that she was not qualified for the Manager position. This led to negotiations for a mutually agreeable outcome. Eventually, Chelsea and the employer reached a settlement via a Deed of Release, outlining specific terms to ensure a fair resolution.

The Outcome:
Chelsea's persistence and our union's support secured a payout of approximately $15000, covering overtime and notice in lieu of work. Notably, the settlement included back payment for overtime that the employer initially disputed. In addition, the Deed of Release ensured Chelsea faced no liability for the investigation, received a statement of service promptly, and secured her annual leave entitlements.

Conclusion:
Chelsea's success is a testament to the power of unity and the importance of having a strong advocate in the face of career challenges. Our nurse union remains committed to protecting the rights and well-being of our members, ensuring they can continue providing quality care without fear of unjust actions.
